How we help you and your family
When someone experiences a major trauma injury they will often go through a number of stages on their journey to recovery. Their goals can vary, but they will include a return to independence, work, or an improved quality of life. In the UK we’re lucky enough to have a national health service that provides high-levels of support during these early stages of dealing with an injury.
Unfortunately, due to the limited funding of statutory services, this support often drops off when someone has been discharged from hospital. That’s where Moore Barlow can help. Watch to find out how.
Rehabilitation
A lawyer’s obligation to act in your best interests should extend beyond securing reasonable financial compensation for you. During the lifetime of your claim, as well as financial support, our expert major trauma solicitors will also focus on arranging a tailored rehabilitation programme that gives you or your family member access to all the specialists you need.
Rehabilitation is a comprehensive and multidisciplinary approach to help individuals recover from severe injuries. It involves physical therapy, occupational therapy, speech therapy, psychological counselling, vocational support and other interventions to maximise recovery and improve outcomes. The goal is to help patients regain independence and quality of life.
The Rehabilitation Code
The Rehabilitation Code 2015 (‘The Code’) is a voluntary code of practice that runs parallel to the civil claims process.
The purpose of The Code is to encourage both parties to work collaboratively and to focus on the injured person’s physical, psychological, social and vocational needs as a priority and at the earliest opportunity.
Although the objectives of The Code apply whatever the needs of the individual, the best way to achieve them will vary depending on the nature of the injury and the individual’s circumstances and goals.
Immediate Needs Assessment
If you have suffered a major trauma, then the earlier the intervention, the better the outcome. We will therefore aim for you to be assessed by a case manager as soon as possible, to identify and obtain funding for the most appropriate rehabilitation programme for you.
Case managers are healthcare professionals who serve as patient advocates to support, guide and coordinate care and rehabilitation. An appropriate case manager will be appointed, who will carry out an initial assessment to identify your immediate needs and develop a plan.

Capacity issues (Court of Protection)
If you or a family member has suffered a serious injury and they no longer have capacity, they may need someone to make important decisions on their behalf, such as controlling and managing their financial affairs. Similarly, if you have a child who has been left severely injured, you will most likely need help with organising their day-to-day needs such as care, education, living arrangements and general welfare. It’s important that you can make well-informed decisions about what you should do in this situation. We can put in place all the necessary arrangements and legal structures, which often involve powers of attorney or deputyships, trusts and wills.
Employment advice
We can help you feel more confident about returning to work after a major trauma, by ensuring your needs are met and your rights are protected. Returning to work after a major trauma can be an anxious time, but with the right help you should feel confident you have the support and arrangements you need to help you manage more easily. If your injuries prevent you from returning to work, you may require support and guidance through the process with your employer.

Conveyancing and housing
After a major trauma, your or your family member’s home may no longer be suitable and you might need alternative accommodation or to adapt your current property. Whether you rent or own your property, we will advise you on your options. Our conveyancing team can help you with a range of legal services, such as buying and selling your home, advising on your lease, obtaining consent for any adaptations and dealing with any disputes.
Care planning
At various stages, you or your family member may require advocacy support to navigate the complex health and social care pathways and assist with any challenges where necessary. This can include NHS Continuing Healthcare appeals, Care Act assessments, best interest meetings and discharge planning. The instructions we follow will be yours alone; it’s important that you are not under pressure from others. We will give you whatever advice you need, for example on issues such as tax planning or how best to protect your assets for future generations. Welfare benefits advisors
You may find yourself in financial difficulty following a major trauma, if you’re unable to work or due to your increased day to day needs. Depending on your circumstances, you may be eligible for certain welfare benefits. We can arrange an initial review with a specialist advisor to check which benefits you may be entitled to and give you advice on how to apply for them. The advisor may also be able to assist if you wish to challenge a decision that has already been made.
Education lawyers
If your child has suffered a major trauma, this can often impact on their access to education. We work closely with a team of education lawyers who can advise on the need for an Education Healthcare Plan (EHCP) and/or any other measures that ensure your child’s needs are addressed and supported.
Immigration lawyers
A major trauma can often be a life-changing event and depending on your circumstances, you or family member may experience immigration-related issues as a result. This can introduce complexities when accessing NHS or social care services and can often be a source of significant anxiety.
