Frequently asked questions: Powers of Attorney

What is the difference between a lasting power of attorney (LPA) and an enduring power of attorney (EPA)?

A lasting power of attorney (LPA) replaced enduring power of attorney (EPA) in 2007, providing more robust safeguarding and flexibility. While an EPA created before October 2007 remains valid, it only covers financial matters. LPAs can cover either financial decisions or health and welfare decisions, offering increased protection and clarity.

Yes, you can appoint multiple attorneys. You can decide whether your attorneys act jointly—meaning they must all agree before making any decisions—or jointly and severally—meaning they can act independently of each other. Choosing multiple attorneys provides reassurance that your affairs remain properly managed if one attorney becomes unavailable.

Yes, a power of attorney can be challenged on valid grounds, such as inappropriate conduct by the appointed attorney, concerns over the mental capacity of the person making the LPA, or allegations of undue pressure. Such disputes require specialist legal advice and may involve intervention from the Court of Protection.

If no lasting power of attorney is in place and mental capacity is lost, family members or close friends may need to apply to the Court of Protection for deputyship. This process is usually longer, more complex and costly compared to setting up an LPA beforehand, so it is strongly recommended to prepare one in advance.
