Frequently asked questions: Family mediation

What happens during a mediation session?

Mediation sessions involve structured discussions between both parties, facilitated by an independent mediator who helps identify issues, discuss possible solutions, and reach agreements that are acceptable to all involved.

The duration of mediation varies according to complexity. Typically, between two and five sessions are needed, with each session lasting around one and a half hours. More complex situations may require additional sessions.

Yes, mediation agreements can become legally binding once formalised in a legally recognised consent order drafted by a solicitor and approved by the court.

In most family disputes, you are required to attend a Mediation Information Assessment Meeting (MIAM) before applying to court unless certain exemptions apply, such as cases involving domestic abuse, child protection concerns or urgency.

If the other party refuses to participate in mediation, you can still proceed to court proceedings. The mediator will provide you with proof of attendance at the MIAM session, enabling you to apply to court directly if necessary.
