How to deal with a dispute, including alternatives to going to court

There are many types of dispute, ranging from contractual disputes to disputes with family members or former partners. You will want to know the potential impact of any dispute and understand your prospects and options. There are other ways to settle a dispute besides going to court, including negotiation and alternative dispute resolution. If you have to go to court, it might be possible to source funding, and there are steps you can take to improve your chances and manage the potential risks of a dispute.

Dealing with a dispute

When you’re facing a dispute, there are critical questions you will want answered. What are my chances of success? How long will it go on for and what will it cost? Is it even worthwhile fighting? What other options do I have?

Although there are many types of dispute, examples that occur frequently include:

  • Contractual disputes, for example arising out of the sale or purchase of shares or other goods.
  • Property disputes, perhaps over boundaries or rights of way.
  • Landlord and tenant disputes, including leases and service charges.
  • Cohabitation disputes, concerning who owns the property following a break-up.
  • Will, inheritance or trust disputes.
