What is involved in the probate process?

The probate process involves proving and validating a will, identifying and gathering the deceased’s assets, settling debts and liabilities, calculating any inheritance tax due, obtaining a Grant of Probate, distributing the estate assets and finalising estate accounts.

The duration of probate varies depending on the complexity of the estate and whether there are any disputes. Usually, uncomplicated estates can take between 6 to 12 months to administer fully, while complex estates might take over 12 months.

If someone passes away without leaving a will (intestate), it might still be necessary to obtain Letters of Administration—similar to probate—to administer and distribute the estate according to intestacy rules.

Inheritance tax (IHT) may be payable on estates valued above the current threshold, known as the ‘nil-rate band’. The standard IHT rate is currently 40%, although various reliefs, exemptions or allowances may be applicable, potentially reducing this liability.

Yes, family members or other individuals with an interest in the estate can contest probate under certain conditions, such as questioning the validity of the will, claims under the Inheritance Act or disputes over entitlement. Such contests may need legal advice to resolve effectively.
