Settlement and British citizenship allow you to stay in the UK without any immigration restrictions. This is a very sought-after status, so it’s not surprising there are many rules and requirements that can make applying seem particularly challenging.

There are two main visa categories that allow you to live in the UK without restriction.


Permanent settlement in the UK is called Indefinite Leave to Remain (ILR). It is also referred to as Permanent Residence for EEA nationals and their families. Once you have been granted ILR status, you are no longer subject to immigration control, although if you leave the UK for more than two years, you will need to re-apply. Once you have been granted ILR, you can exit and re-enter the UK (provided the period is less than two years), take up employment or study, without restriction.

There are several requirements you must meet to apply for ILR. These will depend on which visa you hold, your immigration history, the status of your spouse or partner, and proof that you can maintain yourself financially.

British citizenship

There are various routes to getting citizenship; however, the most common is through residence in the UK. In most cases, individuals will already have obtained ILR or Permanent Residence. Once you are a British citizen, you will be eligible for a British passport and you can exit and re-enter the UK without any restrictions.

You will need to satisfy strict requirements to qualify for British citizenship, including continuous residence, English language skills, good character and passing the Life in the UK test. As with ILR, the onus is on you to prove you satisfy all the requirements. The Home Office will scrutinise your application very thoroughly, especially in areas such as proof of good character.
