Our client was just 16 years old when he sustained a severe traumatic brain injury. He had just completed his GCSEs and was looking forward to college and a career in music, which was his passion.
Sadly whilst on his way home one evening, he was hit by a speeding motor vehicle as he crossed the road.
Our client sustained a significant brain injury and he remained an in-patient in hospital for over 3 months. He later received rehabilitation at Chailey Heritage for a further month.
What was unique about the case?
In addition to the brain injury our client also suffered multiple physical injuries. Through sheer determination and the support of his family, our client made remarkedly progress and his treating doctors referred to him as a miracle.
Although initially liability was in dispute, we managed to put in place a full rehabilitation team to aid his recovery. As our client’s recovery progressed and with the support of the team our client was able to achieve a level of independence that has allowed him to live on his own and succeed at university.
Whilst our client’s brain injury is life-changing and he remains on medication to control his accident-related epilepsy, he has made a remarkable recovery.
Why did the client use Moore Barlow?

What did Moore Barlow do?
Initially the claim was heavily contested, and liability was denied by the insurance company. Accident reconstruction, CCTV analysis and witness evidence was obtained to challenge this position on liability.
In support of our client’s case evidence from experts in the fields of Neurorehabilitation, Neurology, Neuropsychiatry, Neurosurgery and Care among other disciplines were obtained. This step was necessary to determine the value of the Claimant’s claim.
What was the outcome?
Once the full extent and impact of our client’s injuries had been determined and he had completed his university course, we then began to liaise with the Defendants regarding settlements and after a period of negotiation, our client accepted an offer from the Defendant. The offer was subsequently approved by the High Court in London. The settlement included provisional damages in relation to the risk of future uncontrolled epilepsy.
Our client was extremely pleased with his settlement which will give him financial security for the future.
