Successful defence of client in possible breach of Health & Safety at Work Act 1974

A self-employed interior shop designer was investigated for possible breaches of the Health & Safety at Work Act 1974 due to the death of a customer falling down a flight of stairs in one of the shops that she had recently designed.

The Police immediately closed the shop as a potential crime scene and Wandsworth Borough Council Health and Safety Department started investigations.

After visiting the scene, and arranging to represent the client at interviews under caution and at the Inquest, we negotiated with the Council and persuaded them not to prefer any charges against the client, and to take no further action.
