Settlement following a delay in diagnosing prostate cancer

Moore Barlow’s medical negligence team have secured compensation for a 68-year-old man following a late diagnosis of prostate cancer.

Mr K was aware of a family history of prostate cancer and he kept a close eye on his own PSA levels. He drew his GP’s attention to his own rising PSA result on a number of occasions before he was referred on for further investigation. This revealed prostate cancer which it was hoped would be successfully managed by surgery alone, but following surgery, it transpired that the cancer had spread, leading to Mr K requiring additional radiotherapy and hormone therapy.

Although delay in diagnosis was admitted, causation was vigorously disputed. Mr K’s expert evidence supported a claim on the basis that earlier intervention would have avoided spread of the cancer and the need for subsequent radiotherapy and hormone therapy. The defendant’s experts disputed this. There was also a large discrepancy between the parties’ experts as to what Mr K’s prognosis was likely to be.
