Damaged frozen embryos – do you have a compensation claim?

Guy’s Hospital have revealed that faulty freezing fluid has been used on embryos in September and October 2022. The result of which could mean the embryos may not survive the thawing process which is required for IVF.

A safety notice informed Guy’s Hospital of the faulty product in March 2023 but they have only informed affected patients in the last two weeks. It is understood to have impacted some patients who have now undergone cancer treatment potentially affecting their ability to conceive with their own eggs.

The hospital has contacted the individuals affected and issued a formal apology, acknowledging the gravity of the error and its repercussions. Additionally, the hospital has offered counselling and support services to patients recognising the emotional toll of the situation.

The Human Fertilisation and Embryology Authority are working with Guy’s Hospital to investigate and further action will be taken to prevent similar incidents in the future.

Can you claim for medical negligence compensation?

If you have sadly been impacted by this, you may have a product liability claim if your embryos are found to have been damaged by the faulty freezing fluid.  In addition, you may have a medical negligence claim if you have proceeded with cancer treatment and the delay means that you can no longer conceive with your own eggs.

It’s important for affected individuals to seek legal advice as soon as possible to understand their rights and the specifics of pursuing compensation. Legal firms specialising in medical negligence, such as Moore Barlow, offer experienced guidance and representation in these matters.
